What’s The Process For Filing For Divorce In Texas?

One of the questions I got is what is the process of filing for divorce in Texas? So when you begin the process, you’re going to file what’s called an original Petition for Divorce, okay, you can kind of think of that like a letter that is being sent to the judge that saying, Hey, I’m tired of being with this person or that person and I want to get a divorce in Texas. Texas has no fault based divorce just like every other state around so you don’t actually have to prove that you know, somebody has cheated on you, or there’s been cruel treatment or you’ve got bad acts like drug abuse or alcoholism, or somebody’s got a shopping addiction or anything like that. It can be you can walk in and go, God, you’ve got frickin horse teeth, and I’m out of here. And that would be just fine. So after you file an original Petition for Divorce, the court or the district clerk is going to issue what is called citation that’s what basically makes it official. After you get those that is when somebody actually gets served with the lawsuit. Now that can be done by a constable, a sheriff or you can have a private process server, which is what most lawyers use. That’s what we use and always have. So that is how the whole process starts. And then as I say, the fun begins.
