Can I Change Lawyers In The Middle Of A Divorce Case?

Hey folks, Mark Scroggins with Scroggins law group wanted to remind y’all when I’m answering these questions that that y’all have posed, remember that that does not create an attorney client relationship between either myself or Scroggins Law Group and anyone out there. So this is just providing some general thoughts on the questions that y’all pose. My divorce is ongoing, but I’m not really happy with my attorney representing me, can I make a change in representation? Absolutely, you can make a change. Where are you in the process is one question that you should ask. As well as asking the new attorney, what is it going to cost me so one of the biggest expenses that you have, when you make a change is the new attorney has to get up to speed, okay, so it’s not like, if you’re halfway through everything, that they have knowledge of everything that has been going on, and the only way that they gain that knowledge is by one, they want to talk to previous counsel and find out what’s been going on. But then they need to get in and review all the documents and all of the live pleadings, to see exactly where you are in the process and what they think needs to be done. Hopefully, you’ve talked about this in your consult to understand what this is really going to cost. So it typically is going to be an expensive venture. But most of the time, if you are needing to make a change, if you are not feeling like previous counsel is representing your best interests, then you should make a change because you need to have a close relationship with the attorney who is representing you, you need to be able to think that you can go okay, here is my set of problems. You take these and you worry about it, I don’t want to worry about it. Just lead me through this thing and tell me what I need to do. That’s the relationship that you should have with your attorney and you should know what the hell’s going on. So we pride ourselves on making sure that our clients are up to speed on exactly what is happening. That’s why we talk to people on a weekly or bi weekly basis. Okay? That’s something that is super, super important. So if you don’t have any clue what the hell is going on in your case, and you have to call your attorney every time to find out what is going on. That generally is not a good situation, especially if you have a complex property matter or a complex child custody matter. And God forbid you have both. All right. Make sure you hire the right person. Make sure you ask the right questions. Make sure you feel comfortable with the person who’s representing you.
