Can A Parent Change A Child’s Name Without The Other Parent’s Permission?

Hey folks, Mark Scroggins with Scroggins Law Group and before we get into these Q and A’s want to remind everybody that this is just providing a general answer to questions that are posed by our listenership and viewership out there. So I hope these questions are good for you and answer some of the questions that you got, can a parent change the child’s name without the other parent’s permission, that would also include questions about gender? And the answer there is going to be maybe, okay, you know, they can’t just do it without getting the other parents approval unless they go to a court and explain why that is in the child’s best interests. So you can see that child’s best interest is always going to be the overriding issue and the overriding basis upon which every decision in family law is going to be made. So you can’t just do it unilaterally without getting the approval of the other spouse. But you can do it if you show that it is in the child’s best interest to do so.
